Terms of Service

1. Acceptance of These Terms

These Terms of Service ("Terms") govern your access to and use of Stonepath Estates (the "Platform"), operated in Uganda. By creating an account, browsing listings, or using any Stonepath Estates service, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

2. Stonepath Is a Platform, Not a Party to Any Transaction

Stonepath Estates is an online marketplace that connects property owners, agents, service providers, and prospective buyers, tenants, and guests. We are an intermediary only. Stonepath Estates is not a real estate agency, broker, landlord, seller, or party to any sale, lease, booking, or other transaction arranged between users of the Platform. Any agreement for the sale, rental, short stay, or inspection of a property is strictly between the relevant users, and Stonepath Estates bears no responsibility for its performance.

3. No Verification or Guarantee of Listings

Property listings, descriptions, prices, images, and agent or service-provider profiles are supplied by the users who create them. Stonepath Estates does not independently verify land ownership, title status, planning permissions, the accuracy of any listing, or the identity, licensing, or qualifications of any agent or service provider, except where a listing or profile is explicitly marked "Verified" following our own limited internal review process. Even a "Verified" badge is not a guarantee and does not replace independent legal and physical due diligence, which remains the buyer's or tenant's responsibility.

4. User Responsibilities

You agree to: provide accurate and current information when registering and when creating or updating any listing; use the Platform only for lawful purposes; independently verify property ownership, title, and condition before making any payment or entering any agreement; and keep your login credentials confidential. You are responsible for all activity that occurs under your account.

5. Agent and Service Provider Obligations

Agents and service providers listing properties or services must have the legal right to do so, must not misrepresent a property's status, ownership, price, or availability, and must comply with all applicable Ugandan laws governing real estate practice, land transactions, and consumer protection. Stonepath Estates may request supporting documentation before granting or maintaining a "Verified" status.

6. Paid Services, Payments, and Refunds

Stonepath Estates offers paid services including featured listing placements, premium accounts, property inspections, and short-stay bookings. Payments are processed through Pesapal, a third-party payment gateway; Stonepath Estates does not store your card or mobile money credentials. All prices are shown in Ugandan Shillings (UGX) unless stated otherwise.

Because featured-listing placements and premium subscriptions are digital services that begin immediately upon activation, and because inspection and short-stay bookings involve coordination with third parties (agents, property owners, or hosts), all payments are generally non-refundable once a service has been activated or a booking confirmed. Refunds may be considered at Stonepath Estates' discretion in cases of a duplicate charge, a confirmed technical error, or a booking that the other party fails to honour. To request a refund or dispute a charge, contact support@stonepathestates.com within 7 days of the transaction, quoting your payment reference.

7. Prohibited Conduct

You may not: post fraudulent, misleading, or duplicate listings; list a property you do not own or have authority to list; solicit or make payments outside the Platform to circumvent Stonepath Estates' fees or protections; impersonate another person or entity; scrape, harvest, or resell Platform data; or use the Platform to harass, defraud, or discriminate against another user.

8. Suspension and Termination

Stonepath Estates may suspend or terminate any account, remove any listing, or restrict access to the Platform, with or without notice, if we reasonably believe a user has violated these Terms, engaged in fraudulent or unlawful conduct, or posed a risk to other users or to the Platform. Paid services already rendered as of the date of suspension are not refunded except as described in Section 6.

9. Limitation of Liability

To the maximum extent permitted by Ugandan law, Stonepath Estates and its officers, employees, and agents shall not be liable for any indirect, incidental, or consequential loss arising from your use of the Platform, any transaction between users, any inaccuracy in a listing, or any dispute between a buyer, tenant, guest, agent, owner, or service provider. Our total liability for any claim arising from your use of the Platform shall not exceed the total fees you paid to Stonepath Estates in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Stonepath Estates from any claim, loss, or expense (including reasonable legal fees) arising from your breach of these Terms, your listing content, or your conduct toward another user.

11. Governing Law

These Terms are governed by the laws of the Republic of Uganda. Any dispute arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Uganda.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the Platform after an update constitutes acceptance of the revised Terms. Material changes will be highlighted on this page.
